1. Agreement to these Terms
These Terms of Service (the "Terms") govern your access to and use of Profily, available at https://profily.link (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
2. The Service
Profily lets you create public profile pages that gather your links, contact details, and related information in one place, shareable through a single URL. An account may hold one or more profiles. We may add, change, or remove features of the Service over time.
3. Eligibility and Accounts
You must be at least 16 years old, or the minimum age required in your country, to use the Service. When you register you agree to provide accurate information and to keep your credentials confidential. You are responsible for all activity that occurs under your account, whether or not authorized by you. Notify us without delay at mohcinemimoudi@gmail.com if you suspect unauthorized use of your account. We may refuse, suspend, or reclaim accounts created by automated means or registered with false information.
4. Usernames and Profile URLs
Profile usernames determine your public URL (https://profily.link/username). Usernames are allocated on a first-come, first-served basis, but we reserve the right to reclaim, change, or release a username where it infringes a third party's rights, impersonates a person or brand, violates these Terms, is registered primarily for resale, or belongs to an account that has remained inactive for an extended period. Certain names are reserved for system use and cannot be registered.
5. Your Content
You retain all rights to the content you publish on your profiles ("User Content"). By publishing User Content you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute it solely for the purpose of operating, securing, and improving the Service. This license ends when your content or account is deleted, except for residual backup copies retained for a limited period.
You are solely responsible for your User Content and confirm that you hold all rights necessary to publish it. Public profiles are visible to anyone with the link and may be indexed by search engines. The Service is not a backup service — keep your own copies of anything important.
6. Acceptable Use
You agree not to use the Service to:
- violate any applicable law or regulation, or infringe the intellectual property, privacy, or other rights of others;
- publish content that is unlawful, defamatory, fraudulent, hateful, harassing, sexually exploitative, or that endangers minors;
- impersonate any person, brand, or entity, or misrepresent your affiliation with them;
- distribute malware or malicious links, send spam, or engage in phishing or other deceptive practices;
- link to or promote pyramid schemes, counterfeit goods, or other fraudulent offerings;
- interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service, other accounts, or its infrastructure;
- scrape, harvest, or collect data or profiles from the Service by automated means without our written consent;
- use the contact form of a profile to send unsolicited commercial messages or abuse its owner.
7. Moderation and Verification
We may review, remove, or restrict content and suspend or terminate accounts that we reasonably believe violate these Terms, without prior notice. Verified badges are granted at our sole discretion, confirm only that a profile appeared authentic at the time of review, and may be revoked at any time — including automatically when key profile details change. 8. Email Communications
The Service sends transactional email only: account activation, password reset and password-change confirmations, new-login security alerts, and notifications when a visitor submits a message through your profile's contact form. We do not send marketing or promotional email. You can manage optional notifications in your account settings; security-related messages are inherent to operating your account and cannot be opted out of while the account exists. Addresses that permanently bounce or register a spam complaint are automatically excluded from all future sending.
9. Intellectual Property
The Service itself — including its software, design, logos, and branding — is the property of Profily or its licensors and is protected by intellectual property laws. Except for your User Content, you may not copy, modify, distribute, sell, or create derivative works of any part of the Service without our prior written consent. If you believe content on the Service infringes your copyright or trademark, notify us at mohcinemimoudi@gmail.com with sufficient detail to identify the content and your rights; we will review and act on legitimate notices.
10. Third-Party Links and Services
Profiles may contain links to third-party websites and services that we do not control. We are not responsible for their content, policies, or practices, and a link on the Service does not imply our endorsement. Your dealings with third parties reached through the Service are solely between you and them.
11. Fees
The Service is currently provided free of charge. We may introduce paid features or plans in the future; any such change will be announced in advance and will never retroactively charge you for features you already use for free without your explicit agreement.
12. Termination
You may stop using the Service and delete your account at any time from your account settings; deletion removes your profiles and personal information as described in the Privacy Policy. We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, if required by law, if your account creates risk or legal exposure for us, or if we discontinue the Service. Sections that by their nature should survive termination (including 5, 9, 14, 15, and 16) will survive.
13. Service Availability and Changes
We aim to keep the Service available at all times but do not guarantee uninterrupted operation. We may suspend the Service temporarily for maintenance, updates, or security reasons, and may modify or discontinue the Service (in whole or in part) at any time. Where reasonably possible, we will give advance notice of discontinuation so you can retrieve your content.
14. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that content published by users is accurate or lawful.
15. Limitation of Liability
To the maximum extent permitted by law, Profily and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of, or inability to use, the Service — including damage caused by content published by other users or by third-party services linked from profiles. Our aggregate liability for all claims relating to the Service shall not exceed the amount you paid us, if any, in the twelve months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
16. Indemnification
You agree to indemnify and hold harmless Profily and its operators from any claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your breach of these Terms or applicable law.
17. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will post the updated Terms on this page, revise the "Last updated" date, and where appropriate notify you by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree with the revised Terms, stop using the Service and delete your account.
18. Governing Law
These Terms are governed by the laws of the jurisdiction in which the operator of Profily is established, without regard to conflict-of-law principles. Where mandatory consumer-protection rules of your country of residence grant you additional rights, those rights are unaffected.
19. General
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right or provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of the Service. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Profily regarding the Service.
